This wrongful death case alleged that the decedent was not properly restrained by nursing staff allowing him to self-extubate resulting in cardiac arrest, anoxic brain injury and eventual death. The defense proved that the order for restraints was written and followed. Unfortunately, the decedent coded 15 minutes after he was placed in restraints, developed myoclonic seizure secondary to the anoxic episode, was diagnosed with encephalopathy and subsequently died. The jury returned a unanimous no cause verdict. The defense made no settlement offers.
