25-MINUTE JURY DELIBERATIONS RESULT IN UNANIMOUS NO-CAUSE MEDICAL MALPRACTICE VERDICT IN OAKLAND COUNTY TRIED BY JILL H. VANDERCOOK AND ROBERT J. HOARD OF SULLIVAN WARD ASHER & PATTON, P.C.
Plaintiff alleged that she a suffered a worsening of an infection from a prior surgery during the non-surgical treatment of her right ankle fracture by the Defendant Doctor. Plaintiff alleged that the failure to treat or refer her for treatment of the infection sooner caused the need for additional surgeries and IV antibiotics. Plaintiff also claimed that she suffers from permanent disabilities. The defense countered that the Defendant Doctor appropriately assessed and treated the plaintiff at all times and referred the plaintiff for treatment at the first sign of potential infection. The defense also argued there was no infection present during the Defendant Doctor’s care and treatment on plaintiff. The jurors, following their 25 minute deliberations, returned a unanimous No Cause verdict finding that Defendant Doctor complied with the standard of care at all times.
