KEITH FELTY AND JONAS PARKER RECEIVE A UNANIMOUS NO CAUSE VERDICT IN OAKLAND COUNTY
In this medical malpractice action, plaintiff alleged that defendant orthopedic surgeon violated the standard of care by placing an oversized femoral component during a total knee replacement. Plaintiff further alleged that the defendant’s violations of the standard of care caused the need for a revision surgery and life-long injuries.
In response, Mr. Felty and Mr. Parker argued that the component size was appropriate and within the standard of care, and that any post-operative complaints alleged by plaintiff were attributable to his unforeseeable propensity to form post-operative scar tissue and were in no way related to the size of the femoral component.
The jury returned a unanimous 8 out of 8 no cause verdict for the defense in less than 15 minutes.
