Sullivan, Ward, Patton, Gleeson & Felty, P.C. Attorneys Jonas Parker and Keith Felty Recently Secured a No Cause Defense Verdict in a Medical Malpractice/Wrongful Death Act Jury Trial in the Oakland County Circuit Court.

During the case, Plaintiff alleged that defendant cardiologist negligently approved a 44-year-old patient for cardiac stress testing, which resulted in the patient having a myocardial infarct while on the treadmill. In closing arguments, plaintiff asked for the jury to return a verdict exceeding $2 million.

In response, Mr. Parker and Mr. Felty argued that: (1) the patient’s presentation was consistent with unspecified chest pain; (2) all prior testing was negative for coronary artery disease; and (3) cardiac stress testing was the appropriate next step to take to evaluate the patient’s chest pain complaints. After roughly 4.5 hours of deliberation, the jury returned a verdict for the defense.
