Breish v. DeYoung

This matter involved a claim of podiatric malpractice in Macomb County involving a non-union of a first metatarsal phalangeal joint fusion with a patient who had rheumatoid arthritis.  Given plaintiff’s underlying rheumatoid arthritis and osteoporosis, in conjunction with non-compliance, the two attempts at fusion were not successful.  Thereafter, the plaintiff had two further attempts at a fusion by a subsequent treating podiatrist; both those surgeries failed as well.  As a result, the plaintiff was claiming permanent disability.  In closing, plaintiff demanded $150,000.  The jury was out for one hour and returned a unanimous verdict in favor of Sullivan Ward's client.
